This Privacy Policy applies when you visit or use our Website and other services, including products, webinars, trainings, or events, that refer or link to this Privacy Policy (each of which is called a "Service").

Regardless of any (brand) names used on our Website, our European group company Kuraray Europe GmbH (hereinafter: “Controller” or “we”, “our” or “us”) owns or operates the Service, as indicated in this Privacy Policy, and is the first controller of your Personal Data to be provided to, or collected by, the Service.

In this Privacy Policy we explain how we handle the Personal Data that we obtain in our contact with you. Obviously, we will treat the Personal Data carefully and confidentially. Our Website has buttons from social media providers Facebook, Instagram, Twitter, LinkedIn, and YouTube. Our Privacy Policy does not apply to these social media channels. The use of social media is your own responsibility. You may choose to share information on our Website via social media. This means that the information you share, with name and preferences, shall be visible to visitors of your personal pages.

Newsletters

On our Website users are given the opportunity to subscribe to our digital newsletters. We inform our customers and business partners regularly by means of a newsletter about enterprise offers. If you subscribe to our company newsletters, you explicitly give permission to collect your e-mail address. Each newsletter indicates how to unsubscribe.

Our newsletter may only be received by you if you have a valid e-mail address and if you register yourself for the newsletter shipping. We use the double opt-in procedure: a confirmation e-mail will be sent to the e-mail address you registered, for legal reasons. This confirmation e-mail is used to prove whether the owner of the e-mail address as the Data Subject is authorized to receive the newsletter.

During the registration for the newsletter, we also store the IP address of the computer system assigned by your browser and used by you at the time of the registration, your country or region, as well as the date and time of the registration. The collection of this data is necessary to provide legislative guarantees for newsletter registration and to understand the (possible) misuse of your e-mail address later, and it therefore serves the aim of our legal protection.

The Personal Data collected as part of a registration for the newsletter will only be used to send our newsletter. In addition, subscribers to the newsletter may be informed by e-mail, if this is necessary for the operation of the newsletter service or a registration in question, as this could be the case in the event of modifications to the newsletter offer, or in the event of a change in technical circumstances. The subscription to our newsletter may be terminated by you at any time. The consent to the storage of Personal Data, which you have given for shipping the newsletter, may be revoked at any time. For revocation of consent, a corresponding link is found in each newsletter. It is also possible to unsubscribe from the newsletter at any time directly on our website, or to communicate this to our DPO.

Newsletter-Tracking

Our newsletter contains so-called tracking pixel. A tracking pixel is a miniature graphic embedded in such e-mails, which are sent in HTML format to enable log file recording and analysis. This allows a statistical analysis of the success or failure of online marketing campaigns. Based on the embedded tracking pixel, we may see if and when an e-mail was opened by you, and which links in the e-mail were called up by you.

Such Personal Data collected in the tracking pixel contained in the newsletters are stored and analysed by us in order to optimize the shipping of the newsletter, as well as to adapt the content of future newsletters even better to your interests. You are at any time entitled to revoke the respective separate declaration of consent issued by means of the double-opt-in procedure. After a revocation, these Personal Data will be deleted by us. We automatically regard a withdrawal from the receipt of the newsletter as a revocation.

Rights of the Data Subject

You have the right to view your Personal Data processed by or on behalf of us, by request an overview. You have the right to have your Personal Data rectified or restricted (as appropriate). You also have the right to delete your Personal Data. However, deletion of data can only be done if the data is no longer relevant. We will weigh up our interest and your privacy interest upon a request for removal. In the event of a removal decision, we will inform you to what extent this will limit or prevent the use you make of our Service. You have the right to object, on grounds relating to your situation, at any time, to processing of your Personal Data. We shall no longer process the Personal Data in the event of the objection, unless we can demonstrate compelling legitimate grounds for the processing which override your interests, rights, and freedoms, or for the establishments, exercise, or defense of legal claims. If we process your Personal Data for direct marketing purposes, you shall have the right to object at any time. If you wish to exercise any of these rights, please send a request to our DPO. We will respond to your request in accordance with applicable law. To protect your privacy and security, we may ask you to verify your identity.

As a responsible company we do not use automatic decision making. For our digital marketing purposes, we may use any form of automated processing of Personal Data to evaluate certain personal aspects relating to a natural person, to analyze or predict aspects concerning that natural person's performance at work, economic situation, health, personal preferences, interests, reliability, behavior, location, or movements.

The storage & retention of your Personal Data

We store your Personal Data on our local servers in the EU and on the servers of the cloud-based data management provider in the USA. We have established the necessary requirements in order that this processing is in line with EU data protection law.

We will retain your Personal Data for as long as legally required or for as long as necessary to provide you with any requested Service or for the fulfilment or initiation of a contract or as long as we know you are active in the dental industry. Right after expiration of that retention period, the corresponding data is routinely blocked, deleted, or de-identified, in accordance with our group-based retention & erasure policy and schedule.

Sharing your Personal Data

We may need to share Personal Data with others to help us provide our Service to you and to run our Website. Besides group companies or affiliates, we could share Personal Data to parties outside our organization.

With companies that process your Personal Data on our behalf, we have concluded a data processing agreement, or equivalent, to ensure the same level of security and confidentiality of Personal Data. We remain responsible for the processing of the Personal Data provided.

Use of Artificial Intelligence (AI)

We make use of Artificial Intelligence (AI) features provided by our service partner HubSpot in order to improve communication, marketing automation and data analysis. When these AI features are used, personal data that you have provided to us may be processed.

The processing is carried out with appropriate safeguards. HubSpot applies a zero-data-retention policy, meaning that data entered into AI features is not stored by the AI provider after the request is completed. Where applicable, data of users located in the European Union is processed within the EU. In addition, certain identifiers may be masked before processing to protect sensitive information.

The legal basis for this processing is our legitimate interest in improving our services and customer support (Art. 6(1)(f) GDPR). You may object to the use of AI-based processing at any time. All other rights under applicable data protection law, including access, rectification, erasure and restriction of processing, remain unaffected.

Transfer to countries outside EEA

For technical and operational reasons, your Personal Data may need to be passed on to (servers of) companies outside the EEA, preferable in countries with an adequate level of data protection. However, we will always take appropriate measures to ensure that your Personal Data is protected.

Many social media providers are located outside the EEA and store your Personal Data there, which makes it possible that your Personal Data is not protected at the same level as we are used to within the EU. If such transfer of information is not desirable for you, you may prevent this by logging off from your social media account before you call-up our Website.

Our Website and/or Service is intended to (dental) professionals and business contacts. Therefore, we do not intend to collect Personal Data on website visitors under the age of 18. However, we cannot verify that a visitor is over 18. If you believe that we have collected such personal information, please warn us via our DPO.
